1. Agreement

These Terms of Use (“Terms”) govern your access to and use of the Top Grade Tire website, online store, customer account area, and related services (collectively, the “Services”) operated by Top Grade Tire(“we,” “our,” or “us”). By using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Services or place an order. You are responsible for the accuracy of information you provide.

3. Products & Listings

We sell quality used tires and wheels. Product listings describe items available at the time of posting. Used inventory may have normal wear; photos and descriptions are provided in good faith but may not capture every detail.

You are responsible for confirming that a tire or wheel is appropriate for your vehicle before purchase. Our Shop by Vehicle tool and size information are provided for convenience only and do not replace professional fitment advice.

4. Online Orders & Pickup

• Orders placed through the website reserve items for in-store pickup only. We do not offer shipping through the online store.
• You must select a pickup date and time during our posted store hours. We may contact you if an item is no longer available or if your pickup time needs to change.
• Placing an order is a request to purchase. We may cancel or modify an order if inventory is unavailable, pricing was listed in error, or we suspect fraud or abuse.
• Payment is collected in store at pickup. No payment card information is collected through the website checkout.

5. Pricing & Taxes

Prices shown online are before applicable taxes unless stated otherwise. British Columbia GST (5%) and PST (7%) are added to your order subtotal. The total due is shown at checkout and collected at pickup.

6. Cancellations & Returns

To cancel or change a pickup order, contact us as soon as possible at 250-215-8473 or info@topgradetire.com. Return and refund policies for in-store purchases are handled according to applicable consumer protection laws and our in-store policies at the time of sale.

7. Accounts

If you create a customer account, you are responsible for safeguarding your login credentials and for activity under your account. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are used fraudulently.

8. Acceptable Use

You agree not to:

• Use the Services for unlawful purposes or to harass others
• Attempt to gain unauthorized access to our systems, staff tools, or data
• Scrape, crawl, bulk-download, or systematically extract vehicle fitment data or other content from the website or our APIs
• Interfere with the operation or security of the Services

9. Intellectual Property

The Services, including text, logos, images, software, and vehicle fitment lookup data compiled by us, are owned by or licensed to Top Grade Tire and protected by applicable intellectual property laws. You may not copy, reproduce, or redistribute our content or databases except as permitted by normal use of the website.

10. Disclaimers

The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that listings, fitment suggestions, or website content are error-free or complete.

11. Limitation of Liability

To the fullest extent permitted by law, Top Grade Tire will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability for any claim related to the Services will not exceed the amount you paid us for the order giving rise to the claim, or CAD $100 if no purchase was made.

12. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. You agree to the exclusive jurisdiction of the courts located in British Columbia for disputes arising from these Terms or the Services.

13. Changes

We may update these Terms from time to time. The “Last updated” date at the top of this page will change when we do. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
